DISCOVEr
We operate in the following areas :
01.
Employment contracts, regulations and remuneration plans
We draft and revise employment contracts, internal regulations, remuneration plans, non-competition clauses and other elements linked to individual contractual relations. We assist our customers in drawing up or updating their HR documentation, particularly following changes in legislation or internal developments. We are also involved in collective bargaining, and in setting up or renewing collective labor agreements.
02.
Litigation and internal investigations
We represent our clients in proceedings before industrial tribunals and public employment law authorities. This includes individual disputes (unfair dismissal, discrimination, harassment) as well as collective disputes. We also intervene in sensitive internal investigations (discrimination, harassment, interpersonal conflicts), ensuring legal certainty and control of internal communications.
03.
International mobility and immigration
We advise our clients on cross-border relocations, whether temporary secondments, intra-group transfers or permanent relocations to Switzerland. We manage the process of obtaining and renewing work and residence permits, including for key employees and their families. We also assist companies with issues relating to the import of labor or the hiring of services, particularly with regard to specific permits.
04.
Employment law in M&A transactions
We handle all labor law issues relating to mergers, acquisitions and restructuring: transfer of employment contracts, employee information and consultation, collective redundancy procedures, drawing up redundancy plans and coordination with the relevant cantonal authorities.
05.
Executive remuneration and share plans
We support employers in structuring executive compensation, including profit-sharing plans, deferred compensation mechanisms, vesting clauses or departure conditions. We are also involved in negotiating executive employment contracts, or when executives leave.
06.
Social security and occupational pensions
We advise our clients on all issues relating to Swiss social security, particularly in a cross-border context: system coordination, dual affiliation, contributions, self-employment status. We also handle pension issues (LPP), retirement planning and disputes with pension funds.
